A woman in Chennai was held after falsely accusing her husband of raping her 11-year-old daughter. Reportedly, the Madras high court judge was shocked after the investigations revealed that the woman had misused the POCSO (Protection of Children from Sexual Offences) Act to satisfy her selfish needs.
Justice N Anand Venkatesh of the Madras High Court said that "The Case should be a lesson to all those who attempt to use POCSO act for their selfish needs" on August 20 (Tuesday).
Further, the Judge rejected the criminal case against the woman's husband and issued an order to begin criminal proceedings against the wife under Section 22 of the POCSO Act. Upon found guilty of the act, the wife would have to face imprisonment up to six months and pay fine
Back in 2018, the woman's husband sought anticipatory bail at the Madras High Court against his wife's allegations of raping his daughter. Reportedly, the woman and her husband were living separately due to the lack of mutual understanding. In order to own the possession of her 11-year-old daughter, the woman had made false accusations against her husband. She alleged that her daughter became pregnant because of her husband and later, he aborted her pregnancy by means of ayurvedic medicine.
The judge was utterly disappointed by the woman's intentions of falsely accusing a man that he had an "illicit relationship" with his own daughter. He further added that the case had been an eye-opener to the court and brought awareness on how the POCSO Act can be misused.
