A central government notification has reportedly issued a notification stating that its female employees, who have a child through surrogacy, can have a maternity leave of 26 weeks. The directive is based on a 2015 Delhi High Court verdict in a case wherein a Kendriya Vidyalaya teacher was denied maternity leave on grounds that she was not the biological mother. The court said, “A female employee, who is the commissioning mother, would be entitled to apply for maternity leave.”
