Recently, a horrifying incident came to light when a forest officer shared images and the story of an elephant who died in Kerala. A pregnant elephant ate a pineapple stuffed with firecrackers which was planted by some locals in Palakkad district in order to avoid wild animals from getting into their field. The firecrackers exploded in her mouth and she was in immense pain for 2-3 weeks. She died last week, standing in a river, after going through this traumatic experience.

Elephant death in Kerala: What is the Maximum Punishment?

Display of animal cruelty in this horrific incident sparked outrage in Kerala as well as across the country. Many people demanded that the maximum punishment under law should be given for those who are responsible. 

So, what kind of punishment is applicable in this case?

Animal rights are protected under Article 51A(G) of the Constitution. As per the law it is a citizen’s duty to protect wildlife and show compassion for all living creatures. Both state and centre can take action in order to prevent cruelty towards animals and protect wild animals and birds. 

Prevention of Cruelty to Animals Act, 1960 is the one that is generally used to act against cases of animal cruelty. 

However, given the intensity of this crime, the culprits might be prosecuted under the Wildlife Protection Act, 1972. This is a central act that helps in protecting animals, birds and plants. 

The people behind the crime could face a maximum of seven years in jail. The act further states that anyone found guilty of capturing, poisoning, trapping, or baiting a wild animal -- or even attempting to do so – can face a fine of Rs 25,000 or seven years in jail, or both.  

“The elephant was cremated inside the forest in a sombre ceremony presided over by forest officials. Two lives were lost: the mother and the unborn child. The least we can hope is that those who are responsible feel the full force of the law,” Times Now reported.
